Please read these terms, especially section 3. They explain what Quietbeat can do, and what it can't.

Cette traduction vous est proposée pour plus de commodité. En cas de divergence avec la version anglaise, c'est la version anglaise qui prévaut.

The short version
  • Quietbeat is a safety net, not an emergency service. In an emergency, call your local emergency number.
  • We work hard to deliver every alert, but phones, networks and providers can fail, so we can't guarantee it.
  • Only add contacts who have agreed, and never use Quietbeat to monitor anyone without their knowledge.
  • Subscriptions are billed and managed by Apple or Google, and you can cancel anytime in your store settings.

1. About these terms

These terms are an agreement between you and GO RICH MARKETING LLC, a company in the United Arab Emirates (“we”, “us”), about your use of the Quietbeat apps, website and contact pages (together, “Quietbeat”). By using Quietbeat, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Quietbeat.

2. What Quietbeat does

Quietbeat notices signs of activity on your phone and watch, such as steps, opening the app or unlocking your phone. If there's no sign of activity for longer than the check window you choose, Quietbeat asks if you're okay. If you don't answer, it alerts the contacts you chose by push notification and email and, on paid plans, by text message and voice call, and helps them coordinate. Features depend on your plan, device, permissions and country.

3. Quietbeat is not an emergency service

Quietbeat is not an emergency service and doesn't contact emergency services for you. It isn't a medical device. It doesn't diagnose, monitor or treat any condition, and it can't detect falls, seizures or other medical events.

We can't guarantee that a check starts, or that an alert is sent, delivered, read or acted on. Quietbeat depends on things outside our control, including:

  • your phone or watch being on, charged, connected and set up as Quietbeat explains;
  • limits that operating systems place on background activity, battery savers and permissions;
  • mobile networks, the internet, and push, email, text message and voice providers;
  • your contacts' details being correct, and your contacts being available and willing to respond.

Don't rely on Quietbeat as your only way to get help. If you or someone else may be in danger, call your local emergency number right away.

4. Who can use Quietbeat

You must be at least 16 years old and able to agree to these terms. Quietbeat is for personal, non-commercial use.

5. Your account

Keep your details accurate and your devices secure. Follow the setup guidance in the app (for example, allowing notifications), because Quietbeat works best when it can notice your day. Tell us at info@gorich.ae if you think someone else is using your account.

6. Your contacts

Ask people before you add them as contacts. Each contact must accept your invitation before they receive alerts, and they can opt out at any time. Keep their details up to date, and remove anyone who no longer wants to be a contact. You're responsible for the information you add about yourself and others, including your address, access notes and medical card.

7. Setting up Quietbeat for someone else

With the Family plan, you can prepare Quietbeat for another adult, such as a parent. They must install Quietbeat on their own phone and agree to use it. You may not install or set up Quietbeat on someone's device without their knowledge, or use it to monitor anyone in secret.

8. If you're a safety contact

Contacts don't need an account. By accepting an invitation, you agree to receive messages about that member's checks on the channels you choose, as described on the invitation page. Please use the buttons on the contact page honestly, because other contacts rely on them. You can opt out at any time.

9. Acceptable use

Don't use Quietbeat to:

  • harass, threaten or spam anyone, including through invitations;
  • track or monitor a person without their knowledge and agreement;
  • add contacts who haven't agreed, or give false information;
  • break the law or anyone's rights;
  • interfere with, overload, probe or reverse engineer Quietbeat, or get around its limits;
  • resell Quietbeat or offer it to others as a service.

We may suspend or end your access if you break these rules.

10. Plans, subscriptions and payments

Quietbeat has a free plan and paid subscriptions (Plus and Family), sold through the Apple App Store or Google Play and charged to your store account. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app or your Quietbeat account doesn't cancel it.

Refunds are handled by Apple or Google under their policies. If we change prices, Apple or Google will tell you in advance as their rules require, and you can cancel. Text message and voice call alerts are available in supported countries, within a monthly fair-use limit.

11. Apple and Google

If you downloaded Quietbeat from the Apple App Store, Apple's Licensed Application End User License Agreement (the Standard EULA) applies to your use of the app, and these terms apply in addition where they're consistent with it. Apple and Google aren't parties to these terms and aren't responsible for Quietbeat or its support.

12. Beta versions

While Quietbeat is in beta, for example through TestFlight or Google Play testing, features may change or be removed, you may find bugs, and the service may be interrupted or reset. Please use the beta alongside other ways of staying safe, not instead of them, and tell us what you find. The stores' testing programs have their own terms too.

13. Your content

You keep ownership of what you add to Quietbeat, like notes and your medical card. You allow us to store, process and show it as needed to run Quietbeat for you, as described in our Privacy Policy.

14. Our app and brand

Quietbeat, its software, design and brand belong to us or our licensors. We give you a personal, non-transferable, revocable license to use the app under these terms. If you send us feedback, we may use it to improve Quietbeat without any obligation to you.

15. Disclaimers

Quietbeat is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. We don't promise that Quietbeat will be uninterrupted or error-free, or that it will detect every situation in which you may need help.

16. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for loss of data, profits or opportunity. We also aren't liable for harm that results from a check not starting, or an alert not being sent, delivered or acted on, for the reasons described in section 3.

Our total liability for any claim relating to Quietbeat is limited to the amount you paid for Quietbeat in the 12 months before the claim, or USD 50 if you haven't paid anything. Nothing in these terms limits liability that the law doesn't allow to be limited, such as liability for fraud, or for personal injury caused by our negligence.

17. Your responsibility

If you break these terms or misuse Quietbeat (for example, by adding someone as a contact without their agreement), you're responsible for the claims that result against us, to the extent the law allows.

18. Ending your use

You can stop using Quietbeat at any time and delete your account in the app. We may suspend or end your access if you break these terms, or if we have to for legal or security reasons. Where we can, we'll tell you first. If we ever discontinue Quietbeat, we'll give you reasonable notice. Sections that by their nature should continue, such as sections 3, 15, 16 and 20, still apply after your use ends.

19. Changes to these terms

We may update these terms. If the changes are important, we'll tell you in the app or by email before they take effect. If you keep using Quietbeat after that, the new terms apply.

20. Governing law and disputes

These terms are governed by the laws of the United Arab Emirates. This doesn't take away any mandatory protections you have as a consumer under the laws of the country where you live, including the right to bring a claim in your local courts. Before going to court, please email us so we can try to solve the problem together.

21. General

If any part of these terms can't be enforced, the rest stays in effect. If we don't enforce a right, we haven't given it up. You may not transfer these terms without our consent. We may transfer them as part of a reorganization or sale, keeping your rights intact. These terms and our Privacy Policy are the whole agreement between us about Quietbeat.
